Fargo Man Sentenced on Federal Firearm Charges
FARGO — United States Attorney Timothy Q. Purdon announced that on January 13, 2011, Jason Von McCubbin of Fargo, North Dakota, was sentenced before United States District Court Judge Ralph R. Erickson on charges of possession of firearms by a convicted felon and possession of stolen firearms.
McCubbin, 31, pleaded guilty on November 4, 2010, to selling two firearms, a Smith and Wesson .357 caliber revolver and a Smith and Wesson .22 caliber revolver, to an undercover Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF) agent on January 3, 2010, in Fargo, North Dakota. McCubbin had previously been convicted of numerous felonies and was prohibited from possessing firearms. Due to the prior felony convictions McCubbin was deemed an Armed Career Criminal under the federal law. Further investigation discovered that the firearms had been stolen in a residential burglary owned by a law enforcement officer in Clay County, Minnesota.
Judge Erickson sentenced McCubbin to 15 years’ imprisonment to be followed by three years of supervised release. McCubbin was also ordered to pay a $200 special assessment to the Crime Victim’s Fund
The case was investigated by the Bureau of Alcohol, Tobacco, Firearms and Explosives. Assistant United States Attorney Keith Reisenauer prosecuted the case.
