Man Indicted for Mail Fraud and Theft of Firearms from a Gun Dealer

FRESNO, Calif. – United States Attorney Benjamin B. Wagner announced today that a federal grand jury returned an indictment charging Brandon Shawn Greene, 37, of Fresno, with 10 counts of mail fraud, six counts of theft of firearms from a federal firearms licensee, and six counts of theft of firearms.

This case is the product of an investigation by the Bureau of Alcohol, Tobacco, Firearms and Explosives, the Reedley Police Department, and the California Department of Justice Firearms Division. The case is being prosecuted by Assistant United States Attorneys Kimberly Sanchez and Stanley A. Boone.

According to the indictment, Greene was the manager of Liberty Firearms in Reedley, a federal firearms licensee. Between March 2007 and September 2009, Greene unlawfully obtained over $15,000 in firearms and merchandise from Liberty Firearms.

The maximum statutory penalty for the charges is a $250,000 fine per count, 20 years in prison for each mail fraud count, 10 years in prison for each theft of firearms from a federal firearms licensee count, and five years in prison for each theft of firearms count. The actual sentence, however, will be determined at the discretion of the court after consideration of any applicable statutory factors and the Federal Sentencing Guidelines, which take into account a number of variables.
