Rosebud Man Sentenced as Drug User Possessing Firearm
United States Attorney Brendan V. Johnson announced that a Rosebud, South Dakota, man charged with being a Drug User in Possession of a Firearm was sentenced on October 1, 2012, by United States District Judge Roberto A. Lange. David Kills In Water, age 26, was sentenced to 1 month in custody, 2 years of supervised release, and a $100 special assessment to the Victim Assistance Fund.
Kills In Water was indicted by a federal grand jury on March 13, 2012, and pled guilty to the charge on July 12, 2012.
The conviction stems from an April 23, 2011, incident when the Rosebud Tribal Police conducted a traffic stop on a vehicle being driven by David John Kills In Water. When the officers questioned him, Kills In Water denied drinking but said he had been smoking marijuana. During a DUI search, the officers found a live .25 caliber round in Kills In Water=s pants pocket. Further investigation revealed a pistol in the glove box of the vehicle, marijuana cigarettes, and a plastic baggie of marijuana.
The investigation was conducted by the Rosebud Sioux Tribe Police Department, the Northern Plains Safe Trails Drug Enforcement Task Force, and ATF. The case was prosecuted by Assistant United States Attorney Jay Miller.
Kills In Water will report to the United States Marshal's Service on October 5, 2012, to begin serving his sentence.
