Elmira Man Pleads Guilty to Gun Charge

ROCHESTER, N.Y.—U.S. Attorney William J. Hochul, Jr., announced today that Marques Cayne, 30, of Elmira, N.Y., pleaded guilty before U.S. District Judge Charles J. Siragusa, to possessing a stolen firearm in and affecting interstate commerce. The charge carries a maximum penalty of 10 years in prison, a fine of $250,000.00, or both.

Assistant U.S. Attorney Charles E. Moynihan, who is handling the case, stated that on January 4, 2013, members of the New York State Department of Corrections and Community Supervision went to the defendant’s residence in Elmira to conduct a compliance check on Cayne, who was on parole supervision at the time. While there, officers, assisted by members of the Elmira Police Department, discovered a stolen handgun, along with a second firearm in the defendant’s bedroom.

The plea is the culmination of an investigation on the part of Special Agents of the Bureau of Alcohol, Tobacco, Firearms and Explosives, under the direction of Special Agent in Charge Thomas J. Cannon, the Elmira Police Department, under the direction of Chief Michael Robertson, and members of the New York State Department of Corrections and Community Supervision, under the direction of Acting Commissioner Anthony Annucci.

Sentencing is scheduled for May 5, 2014 at 3:15 p.m. before Judge Siragusa.
