Defendant Sentenced on Federal Firearm Charge

Project Safe Neighborhood Prosecution

United States Attorney Kenyen R. Brown of the Southern District of Alabama announces today that Andre Deon Todd of Mobile was sentenced following an August 2014 guilty plea to a charge of being a prohibited person in possession of a firearm. Todd was previously convicted in Mobile County of Discharging a Gun into an Occupied Vehicle and Receiving Stolen Property in 2006; and, Possession of Cocaine in 2006 and 2008. By virtue of these convictions, Todd is prohibited from possessing firearms or ammunition.

On April 12, 2014, officers of the Mobile Police Department responded to a call that a vehicle being driven by Todd was chasing a tow truck which was towing Todd’s vehicle. Once the vehicle driven by Todd was stopped, his passenger provided a statement that when confronting the tow truck driver Todd had the firearm, a .38 caliber revolver, in his hand, but did not point it at anyone.

Possession of a firearm or ammunition by a previously convicted felon is a violation of Title 18, United States Code Section 922(g)(1). United States District Court Judge Kristi K. Dubose imposed a 37 month sentence of imprisonment, to be followed by 3 years supervised release.

This case was referred for prosecution by the Mobile Police Department and investigated by Special Agent Wade Vittitow of the Bureau of Alcohol, Tobacco, Firearms & Explosives.
