Bureau of Alcohol, Tobacco, Firearms and Explosives

MADISON, WIS. -- A federal grand jury in the Western District of Wisconsin, sitting in Madison, returned the following indictments today.  You are advised that a charge is merely an accusation and that a defendant is presumed innocent until and unless proven guilty.

 

The maximum statutory sentence is prescribed by Congress and is provided here for informational purposes.  If convicted, the sentencing of a defendant will be determined by the court based on the advisory Sentencing Guidelines and other statutory factors. 

 

Dannell L. Sampson, 32, Rockford, Ill., is charged with robbing an AT&T retail store in Beloit, Wis., on November 1, 2016.  The indictment also charges him with using a firearm, namely a handgun, during a crime of violence.

 

If convicted, Sampson faces a maximum penalty of 20 years in federal prison on the robbery charge.  On the charge of using a firearm during a crime of violence, he faces a mandatory minimum penalty of five years and a maximum of life in prison.  The charges against him are the result of an investigation by the Federal Bureau of Investigation and G-ROC, a task force formed through the FBI’s Safe Streets Violent Crime Initiative to address gang and drug-related violence in Rock County.  Its members include the FBI; Rock County Sheriff’s Office; Rock County District Attorney’s Office; Beloit Police Department; and Bureau of Alcohol, Tobacco, Firearms and Explosives.  The prosecution of this case will be handled by Assistant U.S. Attorneys Timothy O’Shea and Corey Stephan.

John L. Gilbert, 46, Fitchburg, Wis., is charged in a superseding indictment with 10 counts of using a minor to engage in sexually explicit conduct for the purpose of producing a visual depiction of such conduct.  The indictment alleges that he committed these offenses in February 2016 and November 2015. 

 

The superseding indictment also charges Gilbert with one count of distributing child pornography, alleging that he forwarded three visual depictions of a minor engaged in sexually explicit conduct to another individual in February 2016.

 

Gilbert was originally charged in an indictment returned by the grand jury on May 12, 2016, with one count of production of child pornography.  Gilbert was arrested on this charge in May. 

 

If convicted, Gilbert faces a mandatory minimum penalty of 15 years and a maximum penalty of 30 years in federal prison on each production charge.  He also faces a mandatory minimum penalty of five years and a maximum of 20 years on the distribution charge.  The charges against him are the result of an investigation by the Madison Police Department.  The prosecution of this case will be handled by Assistant U.S. Attorney Elizabeth Altman.

 

 

Curtis E. Powell, 34, Madison, Wis., is charged with two counts of distributing heroin and one count of possessing heroin with the intent to distribute.  The indictment alleges that he committed these offenses on October 10 and 11, 2016. 

 

If convicted, Powell faces a maximum penalty of 20 years in federal prison on each charge.  The charges against him are the result of an investigation by the Dane County Narcotics Task Force.  The prosecution of this case will be handled by Assistant U.S. Attorney Timothy O’Shea.

 

Eloy Flores-Zuniga, 31, a citizen of Mexico found in Jefferson County, Wis., is charged with reentering the United States after previously being deported.  The indictment alleges that he was found in the U.S. on November 3, 2016.

          

If convicted, Flores-Zuniga faces a maximum penalty of 10 years in federal prison.  The charge against him is the result of an investigation by U.S. Immigration and Customs Service.  The prosecution of this case will be handled by Assistant U.S. Attorney Timothy O’Shea.
