MADISON, WIS. -- A federal grand jury in the Western District of Wisconsin, sitting in Madison, returned the following indictments today. You are advised that a charge is merely an accusation and that a defendant is presumed innocent until and unless proven guilty.

The maximum statutory sentence is prescribed by Congress and is provided here for informational purposes. If convicted, the sentencing of a defendant will be determined by the court based on the advisory Sentencing Guidelines and other statutory factors.

Two Madison Men Charged with Armed Bank Robbery

Jay’von Flemming, 24, and Kenny Furdge, 24, both of Madison, Wis., are charged with the armed robbery of Home Savings Bank in Stoughton, Wis., on October 17. They are also charged with brandishing a firearm during the robbery. Finally, the indictment charges each man with being a felon in possession of firearms. The indictment alleges that on October 17, they possessed two handguns.

Flemming and Furdge were arrested on October 17 and have been in custody since their arrest. Their initial appearance date in federal court has not been set.

If convicted, Flemming and Furdge face 25 years in federal prison on the armed bank robbery charge, a mandatory minimum seven years on the charge of brandishing a firearm during a crime of violence, and 10 years on the felon in possession charge. Federal law requires that any penalty on the brandishing a firearm charge be served consecutive to any sentence imposed on the bank robbery charge.

The charges against Flemming and Furdge are the result of an investigation by the Stoughton Police Department, Dane County Sheriff’s Department, Federal Bureau of Investigation, and Bureau of Alcohol, Tobacco, Firearms and Explosives. The prosecution of this case is being handled by Assistant U.S. Attorney Robert Anderson.

Douglas County Man Charged with Receiving Child Pornography

David Tjader, 43, Maple, Wis., is charged with three counts of receiving visual depictions of a minor engaged in sexually explicit conduct. The indictment alleges that he received the child pornography via e-mail on June 16 and July 2, 2017.

If convicted, Tjader faces a mandatory minimum penalty of five years and a maximum of 20 years in federal prison on each count. The charges against him are the result of an investigation by the Federal Bureau of Investigation’s Child Exploitation Task Force, Douglas County Sheriff’s Department, Superior Police Department, Sheboygan County Sheriff’s Department, West Allis Police Department, and Milwaukee Police Department. The prosecution of this case is being handled by Assistant U.S. Attorney Elizabeth Altman.

Beloit Man Charged with Drug and Gun Crimes

Rayshaun Roach, 35, Beloit, Wis., is charged with three counts of distributing heroin, one count of possessing heroin with the intent to distribute, possessing a firearm in furtherance of a drug trafficking crime, and being a felon in possession of a firearm.

The indictment alleges that he distributed heroin on July 12, September 19, and September 28, 2017, and that he possessed heroin with the intent to distribute on October 3, 2017. The indictment alleges that on October 3, he possessed a 9mm pistol and a .32 caliber pistol.

If convicted, Roach faces a maximum penalty of 20 years in prison on each drug count, a mandatory minimum penalty of five years and a maximum of life on the charge of possessing a firearm in furtherance of a drug trafficking crime, and 10 years on the felon in possession charge. Federal law requires that any penalty on the possession of a firearm during a drug trafficking crime be served consecutive to any sentence imposed on that drug trafficking charge.

The charges against Roach are the result of an investigation by the Rock County Sheriff Office’s Special Investigations Unit and GROC, a task force consisting of the Federal Bureau of Investigation; Rock County Sheriff’s Office; Rock County District Attorney’s Office; Beloit Police Department; and Bureau of Alcohol, Tobacco, Firearms and Explosives. The prosecution of this case is being handled by Assistant U.S. Attorney Rita Rumbelow.

Two Charged with Illegal Reentering United States

In unrelated cases, two foreign nationals are charged with illegally reentering the United States after previously being deported. Gilberto Alfonzo Camargo-Cortes, 34, a citizen of Mexico, was allegedly found in Marathon County on August 6, 2017, and Luis

Solis-Ramos, 34, a citizen of Guatemala, was allegedly found in Sauk County on October 2, 2017.

If convicted, each faces a maximum penalty of two years in federal prison. The charges against them are the result of investigations by U.S. Immigration and Customs Enforcement. The prosecution of Camargo-Cortes is being handled by Assistant U.S. Attorney Darren Halverson, and the prosecution of Solis-Ramos is being handled by Assistant U.S. Attorney Antonio Trillo.
