Waco Verdict

in the civil lawsuit involving ATF's 1993 law enforcement operation at
Mount Carmel near Waco, Texas an advisory jury answered special interrogatories
to assist the judge in making a final decision in the case. The advisory
jury found that ATF did not use excessive force either by firing at Mount
Carmel without provocation or by using indiscriminate gunfire at Mount
Carmel. These findings are not binding on the court. The judge, under
the law, makes the final decision. These findings as they pertain to ATF
were consistent with the findings of the Treasury Department review of
Waco conducted in 1993 that ATF agents were ambushed and engaged in a
disciplined response to this unprecedented attack on law enforcement officers.
