Gun Trafficker Sentenced to 51 Months Imprisonment

United States Attorney Karen P. Hewitt announced that Scott Alan Duchene was sentenced today in federal court in San Diego by United States District Judge William Q. Hayes to serve 51 months in federal prison based on Duchene’s conviction for federal firearms violations. Judge Hayes also sentenced Duchene to serve a three-year term of supervised release and ordered all firearms involved forfeited to the United States.

According to court records, Duchene pled guilty on August 24, 2009 to three counts of Illegal Transportation and Importation of Firearms, in violation of Tile 18, United States Code, Sections 922(3) and 924(a)(1)(D). In his guilty plea, Duchene admitted that, although he is not a licensed firearms dealer, he illegally transported, or had transported, into the State of California firearms obtained outside of California, including: ten Beretta handguns (.40 caliber and 9mm), one .45 Hi-Point handgun, eleven LAR Grizzly-15 assault rifle receivers, one 7.62 caliber CAI SKS assault rifle, two 7.62 caliber CAI Golani AK-47 assault rifles, one .223 caliber Keltec machine pistol, one Davis Industries .380 caliber P380 handgun, one Bryco Arms .380 caliber model, two .223 caliber DPMS AR-15 assault rifles, and two 7.62 caliber AMD AK-47 assault rifles.

During today’s sentencing hearing, Judge Hayes discussed the fact that Duchene was selling the firearms in San Diego County after illegally obtaining them in Arizona. Judge Hayes also noted that Duchene was previously convicted of numerous drug possession offenses, residential burglary and possession of a destructive device.
