Mission Man Sentenced on Firearm Conviction

Mission, SD —United States Attorney Brendan V. Johnson announced that a Mission, South Dakota, man convicted of Felon in Possession of a Firearm was sentenced on May 6, 2013, by U.S. District Judge Roberto A. Lange. Gary Joe Emery, age 27, was sentenced to 5 months in custody, 5 months of supervised release, and $100 to the Federal Crime Victims Fund.

Emery was indicted by a federal grand jury on September 19, 2012, and pled guilty to the charge on February 6, 2013.

On April 13, 2009, Emery was convicted of a felony in United States District Court – District of South Dakota. On June 10, 2012, Emery possessed a firearm at his residence in Todd County, South Dakota.

The investigation was conducted by the Bureau of Alcohol, Tobacco, Firearms, and Explosives and Rosebud Sioux Tribe Law Enforcement Services. The case was prosecuted by Assistant U.S. Attorney Marie H. Ruettgers Emery was remanded to the custody of the U.S. Marshal.
