The Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) has received inquiries from members of the firearms industry for whom ATF has approved a variance permitting the maintenance of required acquisition and disposition records on computer. Most of these variances require licensees to periodically print a hard copy of the record and store the printout as part of their permanent records. Licensees have asked ATF whether they may download this information to portable data storage devices instead of printing out the information.

Regulatory Final Rule - 02–9633 - Elimination of Application To Remove Tobacco Products From Manufacturer’s Premises for Experimental Purposes - April 19, 2002 [PDF - 36.83 KB]

This final rule eliminates the requirements that manufacturers of tobacco products apply to ATF to remove tobacco products from their factories in bond for experimental purposes and that they maintain the approved applications for their records. In place of these requirements, manufacturers of tobacco products will prepare and maintain records of tobacco products removed from their factories in bond for experimental purposes. In addition, this final rule defines ‘‘experimental purposes’’ under section 5704(a) of Title 26 of the United States Code.

The Department of Justice is amending the regulations of the Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF) to clarify that the requirements of part 555 do not apply to model rocket motors consisting of ammonium perchlorate composite propellant, black powder, or other similar low explosives, containing no more than 62.5 grams of total propellant weight, and designed as single-use motors or as reload kits capable of reloading no more than 62.5 grams of propellant into a reusable motor casing.

This rule amends the regulations of the Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF) to extend the standard term of import permits for firearms, ammunition, and defense articles from 1 year to 2 years. The additional time will allow importers sufficient time to complete the importation of the authorized commodity. In addition, it will eliminate the need for the importer to submit a new import application, ATF Form 6, where the importation was not completed within the 1-year period. Extending the term of import permits will result in a substantial cost and time savings for both the industry and ATF, and will not cause any discernible adverse effects. This rulemaking proceeding is included in the Department of Justice’s retrospective review plan developed pursuant to Executive Order 13563, ‘‘Improving Regulation and Regulatory Review.’’

The Department of Justice is amending the Bureau of Alcohol, Tobacco, Firearms, and Explosives regulations to clarify that “bump fire” stocks, slide-fire devices, and devices with certain similar characteristics (“bump-stock-type devices”) are “machineguns” as defined by the National Firearms Act of 1934 (NFA) and Gun Control Act of 1968 (GCA), because such devices allow a shooter of a semiautomatic firearm to initiate a continuous firing cycle with a single pull of the trigger.

This industry circular warns businesses about selling or holding for sale tobacco products and cigarette papers or tubes manufactured in the United States and labeled for exportation. On or after Feb. 7, 2001, if you sell or hold for sale such products for domestic consumption, you may incur civil and criminal penalties.
