The information on ATF Form 4587 (5330.4) is used to register an individual or company as an importer of U.S. Munitions Import List Articles. This Information Collection (IC) is being revised to include two attachment pages, one for Additional Responsible Persons and the other for Additional Locations. Revisions will also include sentence rephrasing/statement modification, an added definition, and renumbering.

Title:
National Firearms Act (NFA)—Special Occupational Taxes (SOT)
Action:

Purpose:
ATF has been collecting Special Occupational Taxes (SOT) under the National Firearms Act (NFA) (Title 26, U.S.C. Chapter 53). Firearms dealers, manufacturers, and importers must pay this tax in order to conduct multiple transfers of specified weapons (such as machine guns) within the tax year. The Information Collection (IC) OMB 1140–0090 is being revised due to the removal of the previously corresponding ATF Forms 5630.5R and 5630.5RC. These forms will no longer be required going forward. ATF Form 5630.7 will be the only form necessary to fulfill the requirement for this IC.

Title:
International Trade Data System Test—Cessation of Voluntary Export Pilot (2018R-02)

Purpose:
ATF announces cessation of its voluntary participation in a U.S. Customs and Border Protection (CBP) pilot test of the International Trade Data System (ITDS) for processing import and export-related ATF forms and data using the Partner Government Agency (PGA) Message Set and the Automated Commercial Environment (ACE). This notice concludes ATF participation in the pilot for the exportation requirements. While this notice announces the cessation of the pilot program, CBP has not yet announced the date that filing entries in ACE will be mandatory. The pilot test allowed participating exporters to submit ATF Form 9, Application and Permit for Permanent Exportation of Firearms (Form 9), and additional information to CBP electronically to obtain CBP certification of exportation. During the pilot, CBP validated that information and electronically transmitted export information to ATF to satisfy CBP’s certification requirements.

The list covers not only explosives, but also blasting agents and detonators, all of which are defined as explosive materials in 18 U.S.C. 841(c). The 2019 list is the same as the 2018 list published by ATF, except that the 2019 list adds four explosives not previously listed.

The 2017 Annual List of Explosives inadvertently omitted a letter in one of the explosive materials. This notice does not make any substantive changes to the 2017 annual list; however, it corrects the list and publishes the 2018 Annual List of Explosive Materials.

The Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) will participate in a U.S. Customs and Border Protection (CBP) pilot test of the International Trade Data System (ITDS), using electronic processing of export data through the Automated Export System (AES) which is accessed within CBP's Automated Commercial Environment (ACE). The ACE portal would allow Exporters of National Firearms Act (NFA) firearms to submit data via the AES Direct system.

Purpose:
Northrop Grumman Systems Corporation, a wholly owned subsidiary of Northrop Grumman Corporation, has been granted relief from the disabilities imposed by Federal laws by the Director of ATF with respect to the acquisition, receipt, transfer, shipment, transportation, or possession of firearms. Northrop Grumman Systems Corporation submitted an application to request relief from Federal firearms disabilities due to prohibiting criminal convictions of the three non-surviving entities who NGSC merged with and succeeded, namely TRW Electronic Products, Inc., TRW, Inc. and Litton Applied Technology Division.

Pursuant to 18 U.S.C. 841(d) and 27 CFR 555.23, ATF must publish and revise at least annually in the Federal Register a list of explosives determined to be within the coverage of 18 U.S.C. 841 et seq. The list covers not only explosives, but also blasting agents and detonators, all of which are defined as explosive materials in 18 U.S.C. 841(c). ATF has not removed any listing since its last publication of the List of Explosive materials; however, for the purpose of officially clarifying that “pyrotechnic fuses” meet the statutory definition of explosive materials, ATF has added “pyrotechnic fuses” to the List of Explosive Materials.
