The Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) has received inquiries from members of the firearms industry for whom ATF has approved a variance permitting the maintenance of required acquisition and disposition records on computer. Most of these variances require licensees to periodically print a hard copy of the record and store the printout as part of their permanent records. Licensees have asked ATF whether they may download this information to portable data storage devices instead of printing out the information.

Regulatory Final Rule - 02–9633 - Elimination of Application To Remove Tobacco Products From Manufacturer’s Premises for Experimental Purposes - April 19, 2002 [PDF - 36.83 KB]

This final rule eliminates the requirements that manufacturers of tobacco products apply to ATF to remove tobacco products from their factories in bond for experimental purposes and that they maintain the approved applications for their records. In place of these requirements, manufacturers of tobacco products will prepare and maintain records of tobacco products removed from their factories in bond for experimental purposes. In addition, this final rule defines ‘‘experimental purposes’’ under section 5704(a) of Title 26 of the United States Code.

The purpose of this letter is to provide clarification and guidance on alternative permit procedures that comply with the Brady Handgun Violence Protection Act (Brady law) for firearms transfers to unlicensed persons in the Commonwealth of Kentucky. This open letter supersedes the 2006 Open Letter to All Kentucky Federal Firearms Licensees with respect to alternatives to the National Instant Criminal Background Check System (NICS) background check.

The Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) requests $1,229,518,000 for FY 2014, including 5,192 positions and 4,876 full time equivalents (FTE). This request includes a total of $14,587,000 in net adjustments-to-base (ATBs) which will allow ATF to maintain its current mission services. These ATBs will provide the funding to support employee payroll costs for existing staff, as well as resources to support the continued operation of ATFs land mobile radio program.

A manufacturer licensed and qualified under the GCA and NFA may manufacture and maintain an inventory of machine guns for future sale to federal, state, or local government agencies without a specific government contract or official request; provided, the machine guns are properly registered, and their subsequent transfer is conditioned upon and restricted to the sale or distribution of such weapons for the official use of federal, state, or local government agencies.
